Kelly’s Beach Retreat Policies

OCCUPANCY

The occupancy limit for this house is 13. Only infants who sleep in cribs are not counted in the total occupancy. The house is rented for family vacations only. We rent to responsible adults over 25 only. NO SORORITIES, FRATERNITIES, CHURCH GROUPS, WEDDING RECEPTIONS, “HOUSE PARTIES”, “SPRING BREAK” PARTIES, or other such groups are permitted. For groups of unrelated individuals, the average age should be over 30 unless approved by a property manager. Exceeding the occupancy limit, misrepresentation, or subletting are grounds for immediate eviction. Since this is a weekly rental, the expedited eviction procedures set forth in Article 4 of the VRA will apply.

SECURITY DEPOSIT

A security deposit is required for all first time tenants. The security deposit will be used and applied to damages first if it’s required. If damages exceed the security deposit, the tenant will be responsible for the remaining charges. Tenants understand and agree that they are responsible for any damage to the property during their stay including any pet damage, and the cost of any reasonable attorney’s and collection fees.

PAYMENTS

RESERVATION- For first time tenants a $200 payment is due at the time of booking. For prior tenants this payment is not required. This payment reserves your week(s) until the deposit is received. It is not an additional fee and is deducted from future payments.

DEPOSIT- For all tenants’ this payment is approximately 50% of the weekly rental amount and is due no later than 14 days from reservation. If your arrival date is within 45 days, full payment is required. We accept cash, certified funds, travelers’ checks, money orders, personal checks and all major credit cards through PayPal (3% service fee applies). Payments can be made through PayPal, Venmo or most any money transfer service friend to friend for free.

REMAINING BALANCE- This payment covers the remaining balance of your stay and is due 30 days before you arrive. This will include the remaining rental amount, and any unpaid fees such as: pet fees, linens and taxes. If the remaining balance payment is not paid in full 25 days before your arrival date, the owner has the right to cancel your reservation in accordance with the Cancellation Policy without prior notice being given. Keys or door pass code will not be issued, and occupancy will not be permitted without full payment.

INSURANCE

HURRICANE- Hurricane insurance is free to all tenants who booked directly through the owner. All other tenants must review the rental Company’s (VRBO, TripAdvisor) policy. If the authorities issue a “MANDATORY EVACUATION” (associated with a hurricane or another event) order for your rental location, you MUST secure the house and vacate. Upon compliance, Tenant will be entitled to a refund of the prorated rent for each night that Tenant is unable to occupy the Premises because of the order. In a “Voluntary Evacuation”, there is NO REFUND if you choose to leave. All tenants must secure the house prior to evacuation.

House prep for hurricanes:

  • Lock all windows and doors
  • Place all trash cans in outside shower area or lay them on the ground with lids pushed up against the house / lattice
  • Secure all beach chairs in wooden holder
  • Move all loose toys and balls into the utility room
  • Secure exterior door latches on porch and shower doors
  • Turn off A/C
  • Secure and stack deck chairs in porch
  • Leave all keys in the house

TENANT DUTIES

Tenant agrees to comply with all obligations imposed by the Vacation Rental Act
on Tenant with respect to maintenance of the Premises, including but not limited to: (i) keeping the Premises as clean and safe as the conditions of the Premises permit and causing no unsafe or unsanitary conditions in the common areas and remainder of the Premises that Tenant uses; (ii) not deliberately or negligently destroy, deface, damage, or remove any part of the Premises or knowingly permit any person to do so; and (iii) notifying owner by email or cell phone of the need of repairs including smoke detectors.

OWNER’S DUTIES

Owner is required to provide the Premises in a fit and habitable condition. If at
the time Tenant is to begin occupancy of the Premises, the Premises are not in a fit and habitable condition, Owner shall refund to Tenant all payments made by Tenant. Owner shall maintain and make necessary repairs to property and appliances as expeditiously as possible after being notified of the needed repair. Owner or contractor shall have the right to enter property and dwelling to examine problem and repair as deemed necessary for the safety and comfort of occupants. Owner shall not be liable for circumstances beyond its control including mechanical failure or inclement weather.

CHECK IN PROCEDURES

Please take special care of this vacation home during your stay as if it
were your own home. Check in time is 4:00 pm. Upon your arrival, please notify us immediately if you do not find the unit clean or in proper repair. The house has a central vacuum which is helpful with sand and fur. During your stay cleaning supplies can be found under the sinks in the bathrooms and kitchen.

CHECK OUT PROCEDURES

Check out time is 10:00 am and is strictly enforced. Listed below are your guidelines to follow before you leave the property. Failure to follow the procedures below when leaving the property may result in an excessive cleaning fee.

  • Place all dirty dishes in dishwasher and start it
  • Remove al items from the refrigerator
  • Remove all trash and place in the ground floor trash cans
  • Check all closets and drawers for personal items and remove
  • Check all windows and doors to ensure that they are locked
  • Strip all beds of sheets and pillow cases and pile up linens (towels in one pile and sheets/pillow cases in another). Do not remove mattress pads, pillow shames, or comforters. For those that included the linen option, starting a load or two of towels in the washing machine is greatly appreciated.
  • Leave all keys hanging next to the refrigerator

Waste Management

Trash pick-up and recycling pick-up is on Wednesdays and Saturday. Bring the trash containers to the end of the driveway the night before pick up days, thank-you.

MAINTENANCE

All equipment should be in proper working order, but you should promptly report anything inoperative. After-hours repairs will be limited to emergency situations only. All efforts will be made to expedite repairs.

INTERNET/CABLE

Internet/Cable service is provided. Occasionally service is interrupted, and many times service restorations are dependent on an outside vendor. All efforts will be made to get the service restored as soon as possible.

PETS

We allow a maximum of two mature well behaved dogs. Pet owner agrees to dispose of refuge into the trash and keep dogs off the beds and furniture. The pet fee is $100 plus tax. All pet related damage to the property is the responsibility of the tenant.

SMOKING

No smoking is allowed in the house. Smoking is allowed outside if special care is taken
to dispose of the cigarette butts properly.

FURNISHINGS AND EQUIPMENT

The house is furnished with dishes, cookware, flatware and various small appliances. Re-arrangement of furniture is prohibited.

LINENS

A linen option is available or you can bring your own. The web site provides details on
each bedroom with bed sizes. The linen option includes bath towels, bath mat, hand towels, sheets and beds being made prior to arrival.

USE OF ELECTRONIC MEANS-NOTICE

The parties agree that electronic means may be used to sign this Agreement or to make any modifications the parties may agree to, and that any written notice, communication or documents may be transmitted electronically to any e-mail address, cell phone number or fax number used by the parties to communicate during the course of this Agreement. Any notices required or authorized to be given hereunder or pursuant to applicable law may also be mailed to Tenant’s address.

CANCELLATION POLICY

Cancellations must be made in writing (email). If you cancel for any reason within 24 hours of booking, you will receive a full refund. Otherwise, Tenant shall not receive a refund unless the beach house is re-rented. If the house is re-rented on the same or greater financial terms set forth herein, Tenant shall receive a refund of all payments made by Tenant, less a cancellation fee in the amount of $50. If the house is re-rented at a discount, Tenant will be responsible for the cost difference in weekly rate between the Tenant’s booking rate and the new booking rate plus the cancellation fee of $50. If the premises are not re-rented, Tenant will not be entitled to a refund of any payment made hereunder. The longer we have to re-rent the house, the better the chance to re-rent at the original rental price.
